Terms of service

These cover beta access. They are shorter than most terms pages because the product is in beta, there is no paid plan yet, and a long contract for a free early-access product is mostly theatre.

Status of the service

Paid Amplification is in beta. The funnel engine, the tracking script and the ad platform integrations are built, and we are actively developing against them. Features may change while the product is in beta.

Concretely, that means you should expect bugs, and you should not make a decision that matters on a number this product gives you without checking it against another source. We would rather say that here than have you discover it.

No availability commitment during beta

There is no uptime guarantee, no service level agreement and no support commitment while the product is in beta. We will try hard, and trying hard is not a contractual term.

We may change, suspend or withdraw features during beta. If we withdraw something you depend on, we will tell you rather than letting you find out from a dashboard.

Your data, and getting it back

Your data is yours. You can export the raw event stream in a format that loads somewhere else without our help, and we consider that a requirement rather than a feature, because a tool you cannot leave is a tool that has stopped needing to earn your business.

To be accurate about the current state: the export path is specified and not yet built. It will exist before the product is generally available. If you need your data out before then, ask us and we will do it manually.

What we ask of you

Install the script on sites you control or are authorised to instrument. Do not use the product to collect data from people who have not been given whatever notice your jurisdiction requires.

Do not use the ingest endpoint to send data you did not collect legitimately. The write key is public by design, which means it identifies your site and authorises nothing, and the compensating controls are ours to enforce rather than yours to test.

Pricing during and after beta

Beta access is free. Pricing has not been decided, which is why the pricing page says coming soon rather than showing numbers we have not committed to.

When pricing exists, beta participants will be told before anything is charged, and nothing will convert to a paid plan without an explicit action from you. Silent conversion of a free beta into a paid subscription is a practice we are choosing not to adopt.

Liability, stated plainly

This is a free beta of an analytics tool. Our liability is limited to the maximum extent the law allows, which for a free service is effectively nothing. If a number this product produces leads you to a bad decision, that outcome sits with you.

That is a normal term and it is also why the product is built to show its own margins of error rather than to look confident.

Ending it

You can stop using the product at any time by removing the script from your site. Ask us and we will delete your data. We can end beta access at any time, and if we do we will give you a way to export first.

Governing law

To be resolved before general availability, alongside the data processing agreement. Stating a jurisdiction here that has not been decided would be inventing a fact, and this page would rather have a gap in it than a fiction.
